1. Definitions

  • “Company”, “We”, “Us”, “Our” refers to Nestivo Realty.
  • “User”, “You”, “Investor” refers to any person or legal entity who registers, uses or intends to use the Platform.

2. Acceptance of Terms

  • Any information provided on the Platform (e.g. estimated returns, projected yields, property data) is for informational purposes only — it does not constitute investment advice or financial recommendation.
  • Investing through the Platform carries risks, including but not limited to loss of part or all of the invested capital, liquidity risk (difficulty or impossibility to resell), market risk, property‑specific risks, regulatory changes, default or bankruptcy risk, or delays in rental income or property sale.


5. Investor Acknowledgement of Risk & No Guarantee

  • By participating in an Investment Offer, You confirm that You understand and accept that investments are inherently risky.
  • You acknowledge that there is no guarantee of profit, fixed return or capital preservation.
  • You understand that in many real estate investments — especially fractional‑ownership or crowdfunded models — liquidity may be limited; You may not be able to exit the investment quickly, or at the price you expect.

  • Nestivo Realty will endeavour to provide accurate and up‑to‑date information for each investment opportunity: property details, financial projections, fees, risks, documentation, and disclaimers.
  • Nevertheless, information may change — valuations, market conditions, rental income, costs — and past performance is not indicative of future results.
  • You acknowledge that You have the responsibility to perform Your own due diligence before investing (or engage legal / financial / tax advisors).


7. Intellectual Property & Use of Platform Content

  • All content on the Platform (text, images, design, data, graphics, logos) is the property of Nestivo Realty or its licensors.
  • You may not copy, reproduce, distribute, or use the content for any commercial or public purpose without prior written consent.
  • You may use the Platform only as permitted by these Terms; you may not reverse‑engineer, scrape, or interfere with the Platform’s operation.


8. Account Suspension, Termination & Platform Changes

  • Nestivo Realty reserves the right to suspend or terminate any User account at its discretion — e.g. violation of these Terms, fraudulent activity, legal non‑compliance, or at Company’s discretion.
  • Nestivo Realty may modify, update or discontinue parts of the Platform (features, layout, services) at any time — with or without notice. Continued use of the Platform after modifications constitutes acceptance.


9. Fees, Payments & Funds Handling (if applicable)

  • Any fees, charges, minimum investment amounts, payment terms or other financial conditions associated with an Investment Offer will be clearly disclosed before you commit.
  • Transactions (investment, withdrawals, distributions) will be processed via the payment methods described on the Platform; You are responsible for providing accurate payment info.
  • Nestivo Realty is not responsible for banking fees, currency exchange fees or other costs outside its control.


10. Disclaimers and Limitation of Liability

  • To the maximum extent permitted under applicable law, Nestivo Realty is not liable for any direct, indirect, incidental, special or consequential damages — including loss of profit, loss of data, loss of investment — arising out of or in connection with use of the Platform or reliance on its content.


11. Privacy and Data Protection

  • Use of personal data (identity, financial info, contact info) is governed by the Privacy Policy. By using the Platform, You consent to collection, processing and storage of data in accordance with that policy.
